I suggest you contact ACCC they will advise what to do 1300 302 502
I do know you will need to write to the company and give them 14 days to answer then you can access your statutory rights.

Thankyou to all who replied, I did not realize it was a year ago so will now go to the archives of the show. Wombat we have done our letter to the dealer and now he has until the 10th April to respond or I go further, formal complaint (have already reported them via verbal complaint) to the ACCC, and also the Consumer Affairs departments in both QLD and Sth Aust, then off to court I go if I have to. I will keep all informed, and once again thanks for your replies.

good to hear you are doing the right thing, and most important keep cpoies of all letters, if they phone you make a note of time and day and what was said, and ask them to confirm in writing
