You can see why that happened, and that is not your fault, that was a defect from new. Luckily you didn't have an accident because of it. Get a good lawyer whom works in the field of defects in Vehicles and trailers. You will win. . . What they will say is that you overloaded it, but that doesn't wash as you can see the defect in the steel composition.

Thats what they want you to do . So you cant claim ! Once you touch it theres possibly bugger all chance of recovering any costs or warranty !!

You need to go to engineer boilermaker/welder, I can see where the defect is, as I did that job in the army. Get one whom will write a report, but you will need him to come out. Show him, proper pics, not from a phone, unless you do a very good pic, where you can zoom in to to see it. The fact that they have offered the bracket to you suggests they want you to repair, thus thereby destroying the F...d up weld. Get a report first. You will have to pay for it, then claim it back from them when you have proof it is their Fault. .

Has this Chassis model had a recall? www.gnschassis.com.au/technical-bulletins-recalls/ Who refused to rectify; Green RV, Nextgen or G&S Chassis? Green RV under Australian Consumer Law is person responsible to repair or replace.

I'm sorry if this response offends you.
Looking at the failure, the best solution would be to find an engineering workshop near you, and get it repaired by professional.
The time and effort being wasted trying to a warranty repair is not just worth it, as for engaging engineers reports and lawyers etc to get it repaired what a load of BS. One solution offers you an almost immediate repair, the other could lasts many months or years preventing it's use !

That should not be a big job for an Engineering firm to grind out and weld up (and probably put a simple brace on it and the other side as well ) and you can continue on up the road .

Green RV are a reputable dealer and I have no doubt if you put your case to them without threat they will find a solution.
Airing your complaint on here will not help.
My advice...talk to Green RV.

Good advice Montie, but I wonder if the OP's time could have been better spent simply getting the repair completed? And his stating "...things are about to get ugly" surely is a joke? After all,the vehicle is 3 years old,and who knows where it has been,or what loads it has carried? Better to just get it welded up,with maybe a couple of the braces that BGT suggested, and continue their travels,as Graham says.Life's too short.Cheers

With the backing of engineering evidence there might be a possible case for the Tribunal, but as the van is now 3 years old it would need some convincing proof that the failure was a manufacturing fault rather than normal (or abnormal) usage.
Life's too short...talk to the dealer and take what you can get and move on.

Weld it properly .Add a section of steel same thickness to stop flexing, spread the load . Keep quote, pics etc then send letter of demand etc for costs . What Ive done once or twice is send them Links etc to forums etc Amassing how quick their attitude changes !! As in ACA on ch9 . Make the masses win !!

Given that most new cars come with a five (or seven?) year warranty I would have thought a major frame failure in a caravan at three years is totally unacceptable.

Under the Australian Consumer Law, when you buy products and services they come with automatic guarantees that they will work and do what you asked for. If you buy something that isn't right, you have consumer rights.
If a product or service you buy fails to meet a consumer guarantee, you have the right to ask for a repair, replacement or refund under the Australian Consumer Law. The remedy you're entitled to will depend on whether the issue is major or minor.
You can seek compensation for damages and losses you suffer due to a problem with a product or service if the supplier could have reasonably foreseen the problem. This is in addition to your repair, replacement or refund rights.

If the OP believes the manufacturer has a case to answer in this instance, he can for very little cost lodge a claim under the Consumer Act with the relative Tribunal in his state. Obviously he will be required to provide supported evidence that the failure is a manufacturing fault, which would at least be an engineer's report supporting his claim. The manufacturer may then defend the claim by producing his evidence and once the Tribunal has heard all the evidence they will then make a decision.
Total cost should not be much more than $3/4k including getting reports and legal advice, maybe even less. In some states solicitors are not allowed to attend the hearing without special permission. Unlike the OFT any order made by the Tribunal is enforceable.
It would be advisable to include both the Dealer and Manufacturer in his claim.

My post was for the benefit of those who seem to raise the Consumer Act flag at the drop of a hat!
In this instance it would be totally impractical to pursue a claim as the cost would far outweigh the repair bill.

Absolutely, Montie......I had determined that at a very early stage.People need to put on their 'Big Boy' pants and sort their own problems.Asking questions on a forum about repairing things, for example, often gets positive advice,as has been given in this thread. We can only wish Glen the best of luck, but he will be on the road again much more quickly if he simply bites the bullet and gets the damage repaired....easy repair.Put it all down to experience.......nothing comes with a lifetime warranty.Cheers

I would be suggesting to the firm doing the repair work to do the following as the broken bracket (in the pic..) looked as though it was crystallised from flexing . I would be checking the other side bracket for cracks or flexing and consider adding some type of reinforcing to both sides. My thoughts from experience.....
