4 Year old TV in a new Van

Hi folks,

I must be starting to sound like a Winger

I purchased a new caravan from Noels Island Star. It was built to our specifications.

We took delivery of the van in June 2010.

The van was fitted with a Lenoxx Digital television.

The TV power cable broke and several functions on the remote control do not work.

I contacted Noels about the TV in March 2011 and was told it was not Noels problem and that I had to deal with the Manufacture.

I was contacted by the manager of Lenoxx (TV manufacturer) and was told that the model of TV I have in my van was last manufactured over 4 years ago !

The manager of Lennox said he would honour the warranty even considering the TV was over 4 years old and has since replaced the power cable. I posted the power cable at my expense, He said it would take 2 weeks to return the power cable so in order for us to watch TV in the interim I had to spend $40 to have a 12 volt power lead made up to fit the TV as it had a non standard jack.

He could not find a remote control for the TV.

The TV is not compatible with a universal remote control.

I effectively now have a TV that is useless i.e. extremely inconvenient to use as I have to go to the TV and use the functions on the TV (channel change, volume up/down, menu etc...)

The manufacturer has done all he can as the TV is now (over) 4 years old.

Noels said that they will not take any responsibility for the TV and said that I have to deal with the manufacturer.

Noels are not taking any responsibility for supplying me with a 4 years old TV

 I feel that it would be reasonable to assume that I would get a new TV with a new caravan.

I have sent a copy of this to Caravan and Camping Industries Association of SA Inc

check with consumer affairs. I think that in NSW any  contract is between the purchaser and the seller, not the manufacturer, even though most retailers will try to fob you off if push comes to shove i think they ( the seller) has to take responsibility.       Not sure about other states although I had a problem with JB hi fi in qlsd who eventually came to the party by forcing navman to act even though they initially said it was my problem..

Hi DKay, mate what gives with this crowd......the customer service has been appalling judging by your posts!

You certainly have to contact your consumer affairs dept over the matter, we hope you have a quick and satisfactory outcome.

If I buy a Toshiba laptop from Harvey Norman and something goes wrong with it, the responsibility lies with Harvey Norman, not Toshiba. Why would this be any different.
Go back to your caravan people, perhaps with a document from the TV people saying it is 4 years old and insist you get a new TV or you are going to ACCC or Consumer Affairs or one of the Current Affairs programs on TV, I wouldn't be putting up with it. Stand your ground.

After your win with the axles you may have yet some joy with the TV.

Why not ask them to cough up the price of a new TV with inbuilt DVD player as they are not that exy at the moment.

I suggest you write to the caravan people and request a new tv, point out to them that you will contact consumer affairs if you do not get a satisfactory reply with 14 working days. It is a requirment of Cons affairs that you first talk to the place who supplied the tv (caravan people) then write to them and wait 14 working days then go to your states Consumer Affairs Dept and fill in the forms. I did this recently with a car repair company in Victoria, the manager of the company had a meeting with all staff involved then telephoned me saying he could not work out who was right or wrong so he decided to issue a refund cheque to me, it arrived yesterday. Don't let the Caravan people fob you off.

Go for it! That TV has been dumped on you by Noel's, and is not in the best interest of the customer.
I bought a TV in Carnarvon in '07 and it died in '09, still under the 3 year warranty. I contacted the manufacturer as instructed on the warranty, and they directed me to a repairer in Cairns and it was fixed. Unfortunately it was an LCD flat screen but didn't have digital/HD, so I gave it to my grandsons to watch movies and play games.
In the mean time I bought a new TV with digital/HD for $185 from Big W. Just the thing for the van.
Most of these appliances have a 3 year warranty, so Noel's have handed over a television which was out of warranty and out of date. It does not reflect well on Noels.
It sounds like the manufacturer has really done a good thing helping you out as much as they could, even though the appliance is useless.
I'd have a word to Consumer Affairs about this one. It's all wrong to treat a customer so badly.
A new van should have new appliances. What about the washing machines, dish washers, fridges, hot water services and anything else they provide?
Another lesson for the unwary buyer. We learn so much.

Tell the caravan people that you intend to exercise your statutory rights, then contact accc on 1300 302 502

When I brought our caravan I chose to not take their TV and asked for the price of the TV taken off the price of the caravan and brought our own TV has our son father inlaw is in the Electricial game and told me caravan operators buy bulk straith from China and buy doing so no warrenty

We also provided our own tv, but not for your (brickies) reasons, the info you have been given is wrong in regards to no warrenty, have a look here http://www.accc.gov.au/content/index.phtml?itemId=3863&Go.x=12&Go.y=8 and you only need to read the first 2 paragraphs.

Statutory warrenty is over and above any other warrenty or gurantee, read the whole site, it will explain what is required.

Wombat if you travel oversea and buy duty free and get home and some thing goes wrong most time you have no come back because you didn't buy it in Australia I know people this has happen to . My son father inlaw told me if you buy a product from a retailer dosen't matter how old the product is the warrenty start from the date of sale a 4 year old tv is still new but old technolgy ,most of these tv they put in are not normal brand names

I did not see any mention in DKay's post about buying overseas, DKay did not buy overseas, but you are right about products brought overseas, ie no warrenty.

The brand name does not matter if purchased in Australia you have statutory rights, and it the seller not the manufactuer that is responible for amy claim.

Wombat what I am saying that is what some dealer some caravan dealer are doing if they supply a TV with a new van , when I was buying my new caravan I ask what was the size and make of the TV supplied with the caravan when told I had never heard of the brand when I checked with son father inlaw he said he had not heard of the brand and said some operators source them in bulk from China , so I asked the dealer to take the TV out of the deal and brought my own. just did a Google search on Lenoxx TV a surpise none listed they are showing set top box and recorders so I think my infro maybe right

I have sent a "letter of intent" to Noels and asked them to resolve the issue to my satisfaction or I will persue the matter with ACCC.

I have also sent an email (post content) to: Stuart Livingstone Executive Director Caravan and Camping Industries Association of SA Inc

(of which Noel's is a member) for their advice.

Dkay I think it is not the right to put a sub standard product into something you have paid good money it seem to be be common thing in that industry
