As much as I dislike the man, this experience highlights the fact that Australia has too many "powers that be". I went to the appropriate web sites and was not able to find a consistent message. I shouldn't need to engage a lawyer to interpret the rules for me.

To me the message should be plain and simple and plastered across the home page: If you don't want to be vaccinated, then we don't want you.

After reading a few pages of comments on this topic, it appears that for once most of us seem to agree that he should go.

However, but I am firmly of the view that this is just another (probably successful) example of Scomo's 'Look over here' 'Look over here' tactic that he uses so effectively.  In this case he seeks to divert attention from the Govt's failure WRT timely RAT orders & distribution .. who knows it may even mask attention from their failure to administer Booster shots to Fed Govt controlled Old Age Home residents and their 'let it rip' policy that has seen the explosion of covid positives.

I suspect you are probably 100% correct, what ever his reason, he must be thinking there are votes in it for him!!

I'm not Sure of the answer to the English cricket team question but maybe they all just done the right thing and got vaccinated instead of trying to find loopholes to crawl through.

It's a medical exemption because it's not advisable to have the Covid vax within 6 months of a positive PCR. No different to a the other medically valid reasons that might mean a person may isn't jabbed. However Djokovic wouldn't ever consider the vax anyway. The man is an absolute loon and his personal beliefs are just not credible. Check out his psuedo-scientific statements (I especially like both the gluten and contaminated water comments) and check out the criticism of his stance on Covid vaccination by Serbian govt health authorities.

Let's hope the Minister has the balls to tell the judge who makes the decisions about who enters this country.

Counsel for the Commonwealth Christopher Tran told the court that following the decision, the Minister for Immigration and Citizenship may exercise his discretion to cancel Mr Djokovics visa regardless.

Judge Kelly says he is very concerned about that potential outcome.

I believe any medical advice on how long you need to wait after contracting Covid before getting vaccinated is completely irreverent.
Our border requirements state that he is not eligible to enter Australia, as Cricket Australia were Clearly Informed and have chosen to ignore.

I'm with dorian here lets hope the minister has the balls.

The logic here is interesting:

The judge decided Djokovic had not received "procedural fairness" during his detention at the airport and so negated his arrest and released him into the community.

If I commit a murder but the police fail to afford me procedural fairness will all charges be dropped and I'll be free to go?

I can see that Djokovic may have a damages claim against the Commonwealth but I fail to see why that negates his attempt to enter this country illegally and then go on to spread covid in the community.

A Court of Law does not exist if it does not support and uphold the Law.

It is a criminal offence to criticise a court judgement.

The Commonwealth withdrew its case probably because it did not wish the judge to rule further in regard to the legality of specifying covid jabs as a condition of entry.

My reading on this is that the judge said that DjokoIdiot did not have enough time to prepare a case to appeal his internment, so the case was thrown out. What I want to know is 'How can DjokoIdiot or anyone for that matter come here illegally (without meeting the statutory requirements of the land), and have any legal right to appeal their internment?' This applies to any person who enters the country illegally. Our intrepid leader has said that every person coming into Oz MUST be fully vaxed. How come this guy gets in here without that?

I can see a BIG payout coming DjokoIdiot's way. If he does play (and of course he will), then he stands to win $4.4 Million. If he loses, he will claim that his internment meant that he could not train properly and thus his performance was affected. And who is going to have to pay this?: Guess who?
