Pauline Hanson Judgment

Talk about two bob each way by The Judge, no wonder our resident "xspurt " gets confused sometimes

That is not the judgment. It is a dopey reporter's view on the judgment.

If you wish to read the judgment in full go to Austlii or any of the Court websites.

at the commencement of trials, especially ones that my be lengthy, the Court empanels the jury of twelve and adds a few more. This covers the circumstances that may arise if a juror becomes ill or indisposed during the trial and saves the need to abort the trial and empanel another jury. At the close of the judge's summing up and before the jury is charged to deliberate the judge either discharges the reserve jurists or alternatively can randomly select names to be discharged to reduce the jury number to twelve.

This system is quite usual but our intrepid reporter in the MSM got so worked up it had to be described as "judge axes four members of the jury"

The same imbecile referred to the closing submissions as "final arguments". How can it be an argument when each party addresses without comment from the other side. It is a submission.

Just unbelievable.

Don't you just love the way the newspapers don't let the truth get in the way of a good story. biggrin

Well there has been yet another twist in this saga.

The girl apparently has chosen to consult the media at every turn even when contrary to our clerk of the courts advice and now she may be charged with Contempt of Court.

Tell me if I have observed this incorrectly but was her little tanty on the court steps because she actually had to be cross examined and questioned as to the validity of her accusations. Wow, how dare the defending solicitors do that!

Now it is complicated because a printed google sheet relating to legal considerations was inconveniently or maybe conveniently found in the jury room.
How the hell did that get there?
While jurors are directed not to refer to any outside the court influences, are the courts really that naïve to think that a juror may not watch the news.
Hell, I saw her tanty on the courthouse steps on the 9 news and I could be called as a juror for the new trial.

It appears to me that nothing has gone her way and do we put that down to her claim of alleged bungling in the court or is it just as simple as the Karma Bus arriving to drive her home with her bag of lollies.

.In any case the outcome may not suit the story that she hoped for in the up and coming book.

The media will only report an event if it can be sensationalised.

I have learned that this is not a recent action but has existed even if in the USA for a century or more.

There was a quote from Hurst Newspapers which was their policy.

*When the Lie is Bigger than the Truth then Print the Lie.*

This quote was hi lighted during the trial of Roscoe *Fatty* Arbuckle

Anyone who may be interested can watch the affect of a newspaper story on an innocent person here.

I think it was supposed to read.

*in the past*

just from how I read it.

We all suffer Auto-correction at some time or other and this forum is unforgiving if on the full forum option while on a small device.
